    • Mrs. Jane Carter died the middle of February 1803. At this time her husband was already dead; therefore, he died before 1803. By 1807-8 a Chancery Suit ensued brought by David Carter's heirs against Jesse Walton, Executor of the Estate. It seems to be regarding board of David Carter's orphaned daughter, [who later married Mr. William Smith] and her board while living in his home for 3 years after her mother's death.

      It is pretty clear that the answer to the initial question as it relates to the father of Mary Elizabeth Carter, who married Silas Baughn in 1831, is David Carter who married Jane Flippen Walton, widow of Josiah Walton. The Baughn information Holly reported suggests that there was indeed a young son of Silas and Mary of the same age as the Baughn 12 year old in the household of William R. Carter in Amelia County in 1850. The next question is obviously who is this David Carter, one that I have wrestled with for a while.

      David is one of the three Carter men who appear in Cumberland County, Virginia in the middle of the 18th century with no clear connection to the other Carter families known to be in Cumberland County at that time. The other two were Isham and Hezekiah. Fleming Carter and William Carter, orphans of John Carter, chose Isham Carter as their guardian when they reached the age that made them eligible to so choose. The inventory of the estate of John Carter presented to court on 22 Nov 1773 included 1 Bay Horse in possession of Isham Carter. It is thus reasonable to make the assumption that there was some family relationship between Isham Carter and the deceased John Carter. I believe all three of these men were brothers and sons of John Carter, son of Thomas Carter of Goochland, and a wife who preceded his last wife Mary who became John's widow in 1772.

      There is a gap in the history of John Carter, son of Thomas of Goochland, who settled a plantation on Deep Run of Muddy Creek in Goochland County, later Cumberland. He acquired the land from his father in 1734. The next mention of him is in 1749 when his brother Edward names him in his will as an executor. In 1754 John Carter, Junior is a party to a deed [DB2/77]. Witnessing this deed were Robert Carter and his son Charles which suggests this John Carter, Junior is a son of Robert Carter of Cartersville and that he is called Junior in deference to his uncle John on Deep Run.

      We know he married a woman named Mary whose LWT was recorded in Cumberland on 24 Nov 1794 [WB 3/40]. In this will the widow Mary Carter mentions sons Josiah, Fleming and William and daughter Nancy Carter Creasy. She does not mention two other daughters of her husband John Carter, namely Susannah and Mary who chose their own guardians in 1774 and were thus born between 1754 and 1760. The first indiction of a birth date of her proven children is given by the fact that in 1785 sons Fleming and William chose their guardians thus they were born between 1764 and 1771. It is thus possible that John Carter had one or more wives prior to his marriage to Mary and other children such as his son John who inherited his land as eldest son, the daughters Susannah and Mary as well as others. Son John was granted administration of his estate in 1772 and was thus born prior to 1751.

      We do know that David and Hezekiah were brothers from the filings in a Chancery Case in Cumberland County in 1798. At the time this case was filed David, who married Jane Flippen, widow of Josiah Walton, had removed to Nottoway County, Virginia. I do not have a date of death of David but a Jane Carter appears as the head of household in Nottoway census records for 1830, 1840 and 1850.
      The free whites shown in those census records were:
      1830 2 M 10-14, 1 M 15-19, 1 F 20-29, 1 F 50-59
      1840 1 M 30-39, 1 F 5-9, 1 F 60-69
      1850 Jane Carter 72, William Carter 46

      There is a suitably aged female present in 1830 but not in 1840 who might very well be Mary Elizabeth who left to be married in 1831.

      Sorry, looks like I dropped the ball. There was no will but an accounting of the estate of David Carter in the Will Book. There is some conformation that David Carter and Jane Flippen Walton had a son named Thomas Carter and a daughter named Elizabeth who married William Smith.

      The son Thomas was of lawful age in 1809 when he gave a deposition in the Chancery Suit of William Smith vs Jesse Walton - administrator of the estate of David Carter. This Thomas Carter is of the appropriate age to be a candidate for the Thomas Carter who married Catherine Muse.

      You will learn a great more from the documents found in the following Chancery Case from Amelia County.

      The distribution of the slaves of David CarterÕs estate by the Amelia Court in 1807 recognized only 2 legatees, Thomas Carter and Elizabeth Carter Smith. Since there was no will it is most unlikely that there were other children of David Carter unless they died childless before the distribution.
      The first census of 1790 contained:
      1782 Cumberland Co. David Carter with 6 white and 2 black
      1784 Cumberland Co. David Carter with 7 white
      Based on dates of birth the household in 1782 was likely to include:
      David Carter
      Jane Flippen Walton Carter
      William Scott Walton
      Mary "Polly" Walton
      Jesse Walton
      Josiah Walton
      and the additional white in 1784 was likely to be Thomas Carter, born between the last half of 1782 and the middle go 1784.
      The Scott middle name seems to be associated with Jane Flippen.

      So you revelations about the children of David Carter (died 1803) and Jane Flippen Walton are VERY interesting indeed! It also presents a difficult set of facts for me personally.

      I had long thought that Thomas Carter of Amelia County, Virginia, who married Catherine Muse in 1815, was related (probably a brother) to John Carter of Amelia. In addition to a relative close proximity to their residences within Amelia, also I have found that:
      1. in 1814 Thomas Carter served as a substitute for Joseph Haskew in the Virginia Militia (during the War of 1812). Beginning in 1823, John Carter began purachsing land on the border with or from Joseph Haskew. John's son, William R. Carter, eventually married the niece of Joseph Haskew in 1846, who had left all of his is land holdings to his niece, Mary Elizabeth Pollard, in 1843.
      2. in 1815, the marriage of Thomas Carter and Catherine Muse was witnessed by John W. Foster. In 1821, the (second) married of John Carter and Oney Pollard was witnessed by John W. Foster. (I suspect that John Carter's first wife was a daughter of Stephen Wright, possibly Polly Wright, a ward of John Jeter after Stephen's death.)
      3. in 1853 in the transaction ledgers of John Carter's son, William, it mentions giving the "family best flower" and making collateralized loans to two of the children of Thomas Carter, Henry and Thomas P. Carter. It seems unlikely that such transactions would have been made if there was no family relation.
      I am a direct descendant of John Carter (he is my g-g-g-grandfather). However, my DNA results versus those of a person claiming to be a descendant of Thomas Carter are only a 12 out of 30 marker match. Clearly not enough to make the fraternal connection I was suspecting.

      In this link you will see that in 1812, John Carter was a co-litigant with John Booker and...wait for it...yes...JESSE WALTON! Yes, that's right, the same Jesse Walton that is the administrator of David Carter's estate. The same David Carter whose daughter, Bestsy Scott Carter (note the middle name SCOTT as listed in the LVA documents; more research needed on this...maybe related to William Carter and Jane Smith of Powhatan) married William Smith, and son Thomas Carter married Catherine Muse in 1815.

      The coincidences almost seem too large. As I see it, there are two possibilities:
      1. This is just a random coincidence, where Jesse Walton just happens to be involved with multiple Carter families, or...
      2. Perhaps the person who submitted their DNA as a descendnat of Thomas Carter of Amelia did so in an advertent error and is not actually a descendant of Thomas of Amelia

      I certainly need to get some resolution on the DNA issue regarding Thomas and John, but I have already begun to look for John Carter's origins in Powhatan, and the middle name of Betsy Scott Carter, who marries William Smith, may point that way as well. As a result, maybe David does not point directly back to Thomas Carter of Goochland origins?
