In the name of God Amen I, Theodrick Carter of the Parish & County of Henrico being sick but of perfect Memory do this Twenty Second day of July one thousand seven hundred thirty six make this my last Will and Testament, and first and principally I commit my Soul to Almighty God in whom and by whose Mercy and thro, the Merits of my Blessed Saviour and redeemer Jesus Christ I trust and Assuredly be- lieve to be saved, my Body to the earth to be decantly Buryed at the discretion of my Executx. hereafter named, and as for Disposing my estate I give and devise the same in manner and form following. I give and devise unto my Beloved wife Elizabeth so long as she shall live sole my plantation Land and Appurtenances and after her Death or Marriage, I give unto my Son Theodrick Carter and his heirs forever my said plantation with 218 Acres of Land thereto belonging I give and devise unto my son John Carter and his heirs forever one hundred and Twenty acres Land be the same more or less within the following Bounds, beginning at a corner Beach stand- ing on Round Hill Branch thence along a line of marked Trees to a corner Hickory on the Dividing Line between John Spears and this Land to a Corner Oak on the farther side of the Road thence along the line of John Webb to a corner Tree on Chickahominy Swamp thence up the same to ye place began at; my wife is not to be excluded the use of this Land so long as she shall remain sole, during which time, I give her my Negro named Will and after that time I give him to my son Theodrick with a Negro child named Dick. I give unto my son John and his heirs after the Death or Marriage of his Mother my Negro woman Judith and a Mullato Girl named Lucy with what children they may have when he has a right to the possession of them. I give unto my said Son John one fether Bed Rug and Blanket, one Gun, my great Chist, one pot and Hooks and two Cows, I give unto my Daughter Mary Carter one Cow and Calf one fether Bed, Rug and Blankets, two Ews, one pot and Hooks, two pewter Dishes and two plates and one poringer. I give unto my beloved wife Elizabeth all the rest of my Estate of what kind soever and do make her Executrix of this my last Will and Testament, hereby directing that my Estate shall not be Inventoryed or appraised. In Witness whereof I have hereunto set my hand and Affixed my seal the day and year aforewritten.

At a Court held at Varina for the County of Henrico, the first Monday in Ap'l 1737, this Will was presented by Elizabeth Carter the Executrix upon Oath and proved by the Oath of Thomas Watkins & John Spear two of the Witness thereto and thereupon admitted to record, and on the Motion of the said Executrix, Certificate is granted her for obtaining a probate thereof in Due form.

Notes:

Theodrick Carter, II and Anne Waddill were the parents of Nancy Waddill Carter. Anne Waddill was baptized January 24, 1713, according to the register of St. Peter's parish, which encompassed New Kent County. Her parents were William and Sarah Dennis Waddill. William was elected vestryman of St. Peter's, on June 1, 1704, and served in
this capacity for at least thirty-five years. The author James Branch Cabell,a descendant of John Waddill, discussed the Waddills in his book "The Majors and Their Marriages." Theodrick Carter and Anne Waddill lived for a time in New Kent County. According to the register of St. Peter's parish, their first child John was baptized on October 30, 1737. Theodrick appeared in the Amelia County tithables list of June 10, 1747 in John Nash's district (this area became part of Prince Edward County in 1754); he is absent from the list Nash compiled for the same district on June 10, 1745. He must therefore have migrated from New
Kent County to present-day Prince Edward County sometime between these two dates. Nancy was born June 15, 1749, probably at her father's estate "Hickory Hill" (also known as "Hickory Grove"). According to tradition, the house was built around 1750; however, it may have been built three years earlier, since we know that Theodrick was living in John Nash's tax district on June 10, 1747.
John Wood's 1820 map of Prince Edward County shows the location of Hickory Hill. Two miles west of Hampden-Sydney College is the notation "Capt. Carter's." Captain Carter was Samuel Carter, Nancy's brother. Samuel inherited Hickory Hill from his father in 1777. Destroyed by fire in 1933, Hickory Hill was described four years later in the Works Projects Administration survey of Prince Edward County homes: [Hickory Hill] was not a show place except for its splendid boxwood and cedar hedge and lovely gardens. It was a plain frame house, or rather two houses connected by a little square room. The first of these traditions says it was built in 1750, a story and a half with small rooms except for one large reception room, which was beautifully paneled, and with one side of carved oak. The other part of the house was built by William H. Venable, when he bought the plantation in 1853 from Edward Carter [Samuel's son]. Mr. Venable built a large, square, two-story frame building, with large rooms and ample halls. The many outbuildings around the mansion house made the place quite a little settlement. The large grove of hickories flanking it on the south gave the place its name.
Nancy's father was one of Prince Edward County's most prominent planters. He purchased 975 acres in old Amelia County on September 20, 1748, and bought and sold other parcels of land up to the time of his death. A member of the Anglican church, Theodrick offered 300 acres of land to St. Patrick's parish for its use as a glebe, or plot of land granted to the local clergyman as part of his benefice during his tenure of office.

Thomas and Nancy Thompson probably named their fourth child in honor of her brother, Samuel Carter. Samuel distinguished himself in the military, in politics, and as a businessman. A member of the 1st Virginia Regiment during the Revolutionary War, he and seven other officers were granted the honor of personally welcoming the Marquis de Lafayette during the great soldier and statesman's visit to Richmond in October, 1824 (Richmond Enquirer, October 29, 1824, page 3). Samuel at various times held the county offices of sheriff, magistrate, and coroner; in 1805-1806 he represented Prince Edward County in the Virginia Assembly. In the late 1790s he was a trustee of a company which improved navigation on the Appomattox River. Later, he became a charter trustee of the Junction Canal Company. In 1825 the company constructed a canal which linked the Appomattox and Little Roanoke rivers. John Wood's map of Prince Edward County shows Samuel's mill at the mid-point of this canal.

The Giles of Henrico Clan
Albemarle Co. deed dated 12 Nov. 1760 shows that she, Elizabeth, w/o John Carter, was the daughter of John Gannaway Sr.:

" Jno. Gannaway, Sr. to Theodorick Carter, son of John Carter of Henrico Co....love for Theodorick Carter, grandson..."

John and Elizabeth's son Jacob named one of his children Elizabeth Gannaway Carter (she was mentioned in John's 1785 will as his granddaughter Betsy Gannaway Carter), and another of Jacob's descendants in Henrico Co. was named John Carter Gannaway Epes.

The other Carter is a William Carter. He is mentioned in the chancery documents in 1789 as the defendant against Onan Moody. Onan Moody was the illegitimate daughter (or son, not sure) of Frances Moody and Gerard Ellyson. Gerard's widow, Sarah (nee Crews), married William Carter in 1771. It was published in the Purdie and Dixon Gazette that she was 85 and he only 23! (Making William born in 1748). It also mentions that he is the son of John Carter of Henrico County. (This John Carter is the son of Theodrick Carter, the son of Giles Carter.) William had the following siblings:

3. Frances Carter m. Robert Walton (son of Robert Walton and Mary Hughes, and brother to George Walton, signer of the Decl. of Ind.) in Charlotte County, VA

I am not sure what happens to this William Carter, but I suspect he was widowed not long after (with a pocket full of cash). There are a couple of possibilities of which William Carter he is that turns up later in a different place.
1. William Carter married Mary Scott in Lunenburg County in 1779. He moves to Prince Edward County, where his will is found in 1812. (This seems likely, as then his brother Theodrick was married in the same county in 1763.)
2. William Carter married Jane Scott in Powhatan Co., VA in 1798.
3. William Carter married Sarah Overstreet in Goochland in 1773.
4. William Carter married Nancy Scott in Goochland in 1802.

have this information on the Webbs. I'm not sure how accurate it may be since it as given to me several years ago by another researcher who has since departed this life. Since my line is through the Carter's daughter, Mary, who married Drury Scruggs, I have not spent a lot of time on the Webbs:


First Generation

1. Theodorick CARTER was born about 1671 in Charles City County, Virginia. He died Jul 1736 - Apr 1737 in Henrico County, Virginia. His will dated 22 Jul 1736 and entered into probate in the April term of Court in 1737:

Theodorick CARTER and Elizabeth __(?)__ were married about
1695 in Virginia. Elizabeth __(?)__ was born about 1680. She died between 1747 and 1751 in Henrico County, Virginia. Her will dated 8 Jul 1747 was entered into probate in Dec. 1751.
To her son, Theodorick Carter she left six head of cattle,
the great Bible and a white mare.
To her daughters, Elizabeth Martin, Anne Ferris, Susannah
Scruggs, Martha Garthwright, Mary Scruggs she left personal items and livestock.
To her grandson Cuthbert Webb, livestock.
To her son, John Carter the rest of the estate and he to
be executor.

2. Hannah CARTER (Theodorick-1) was born about 1698.
Hannah CARTER and John WEBB Jr. were married about 1713. John WEBB Jr. was born in 1694 in St. Peter's Parish, New Kent County, Virginia. He died in 1736 in Henrico County, Virginia. His will was probated in Henrico County
in July 1736. It named sons Giles, Theodorick, Henry,
Jacob and Cuthbert.
Wit: James COLE, Theodorick CARTER, Thomas CARTER, John
CARTER. Hannah CARTER and John WEBB Jr. had the following children:

11 ii. James WEBB was born about 1717.
12 iii. Giles WEBB was born about 1720.
13 iv. Theodorick WEBB was born about 1720.
14 v. Henry WEBB was born about 1725.

16 vii. Cuthbert WEBB was born in 1733. He died about 1778 in Albemarle County, Virginia.

3. Ann CARTER (Theodorick-1) was born about 1701. She married (Unknown) FARRIS.
4. Susannah CARTER (Theodorick-1) was born about 1703.

5. Theodorick CARTER Jr (Theodorick-1) was born about 1706 in Virginia. He resided in in Goochland County, Virginia in in 1741 On June 15, 1741 Theodorick Carter of Goochland sold land to Richard Morning and Thos. Bassett. On 16 Nov 1742 Joseph Dobbs sold land to Theodorick Carter. He resided in in Amelia County, Virginia in in 1748 He had a grant of 975 acres at Bush and Briery Roads...in the sections which became Prince William County. He died about 1777 in Prince Edward County, Virginia. Theodorick Carter's will was dated 7 Dec 1777, probated 19 Jan 1778 in Prince Edward County, VA.

Eliza's great-uncle John Carter (through her mother's line) was the father of Francis Watkins Carter, who built the home which is currently open for tours as Carter House Museum in Franklin, TN. One of her cousins was Confederate Lt. Theodorick "Tod" Carter, who died in a battle with Union troops on the lawn of the home during the Battle of Franklin, November 30, 1864. In a sad tale reminiscent of so many of the era, family fought family as Eliza's son John joined the Union in combat with Missouri's Militia Regiment 5, Company B.

There is a Chancery Suit between Waddill Carter's Widow Mildred Wade (Lewis) which is about the proceeds of the earnings from the still. Nancy Waddill Carter (who married Thompson) had a brother, Waddill Carter. I have a copy of Waddill Carter's will from 1782, in which he mentions his "young son John." I am suspecting (but have not proven) that this John may be my long lost John Carter for whom I have spent years searching.

My John Carter first shows up on Amelia County Census
Records in 1820. There is a John Carter on the 1810 Census in Prince Edward who is described as being married and with one infant son (which would match my John's description). It is clear to me that John was married to another woman before he married Oney Pollard in Amelia in 1821, since all three of his children were born before then.
I have been somewhat hung up on the middle name of one of John's sons: Atwood. There are not many Atwoods in Virginia at this time. They seem to either be in Culpepper County (and they all move to present day West Virginia) or in Prince Edward County. Although I have not been able to find intermarriage between the Carters and the Atwoods, I have made this link: James Atwood dies in PEC in 1771. His will is witnessed by James Wade and Charles Wade. James and Charles Wade are the father and brother of Mildred Wade, who married Waddill Carter around 1765 in PEC. The name Atwood is too obscure (unlike say "Franklin") for there not to have been anyone to have known somebody of that name. -Peyton Carter on GenForum

Samuel Carter who was named as one of the trustees was a son of Theodrick (Second) and Anne Carter. Samuel's brother Waddill married Mildred, a daughter of James Wade, who was also named as one of the trustees for widening the river.

Their son, James Boisseau od Dinwiddie County born May 22, 1735, married Anner Fitzpatrick, daughter of Peter Fitzpatrick. Anner and James were the parents of John, born March 14, 1764 John stated on his Revolutionary pension application that his birthday was recorded by his father, James in a book, that was sold at his fathers sale The book was bought by James Sweet of Dinwiddie County. John and Nancy were the parents of Daniel T Boisseau 1793-1873, born in Prince Edward Co, Va,married Feb 3, 1820, Mildred Wade Haskins 1799-1845. Mildred is buried on the Eldon Hall farm of Franklin Ky Daniel T married Susan E Robey, 1820-1897 brn in Rutherford Co Tenn Both are buried in Big Spring Cumberland Presby Cemetery. Daniel and Susan were the parents of Dora C Boisseau, 1860-1937. Dora married Robert Alexander Evans Jr 1851-1919 of Middleton Ky. Evans was the son of Walter W Evans and Susan Catherine Harris. They are buried in Franklin Cemetery.

Theodrick Carter, II and Anne Waddill were the parents of Nancy Waddill Carter. Anne Waddill was baptized January 24, 1713, according to the register of St. Peter's parish, which encompassed New Kent County. Her parents were William and Sarah Dennis Waddill. William was elected vestryman of St. Peter's, on June 1, 1704, and served in
this capacity for at least thirty-five years. The author James Branch Cabell,a descendant of John Waddill, discussed the Waddills in his book "The Majors and Their Marriages." Theodrick Carter and Anne Waddill lived for a time in New Kent County. According to the register of St. Peter's parish, their first child John was baptized on October 30, 1737. Theodrick appeared in the Amelia County tithables list of June 10, 1747 in John Nash's district (this area became part of Prince Edward County in 1754); he is absent from the list Nash compiled for the same district on June 10, 1745. He must therefore have migrated from New
Kent County to present-day Prince Edward County sometime between these two dates. Nancy was born June 15, 1749, probably at her father's estate "Hickory Hill" (also known as "Hickory Grove"). According to tradition, the house was built around 1750; however, it may have been built three years earlier, since we know that Theodrick was living in John Nash's tax district on June 10, 1747.
John Wood's 1820 map of Prince Edward County shows the location of Hickory Hill. Two miles west of Hampden-Sydney College is the notation "Capt. Carter's." Captain Carter was Samuel Carter, Nancy's brother. Samuel inherited Hickory Hill from his father in 1777. Destroyed by fire in 1933, Hickory Hill was described four years later in the Works Projects Administration survey of Prince Edward County homes: [Hickory Hill] was not a show place except for its splendid boxwood and cedar hedge and lovely gardens. It was a plain frame house, or rather two houses connected by a little square room. The first of these traditions says it was built in 1750, a story and a half with small rooms except for one large reception room, which was beautifully paneled, and with one side of carved oak. The other part of the house was built by William H. Venable, when he bought the plantation in 1853 from Edward Carter [Samuel's son]. Mr. Venable built a large, square, two-story frame building, with large rooms and ample halls. The many outbuildings around the mansion house made the place quite a little settlement. The large grove of hickories flanking it on the south gave the place its name.
Nancy's father was one of Prince Edward County's most prominent planters. He purchased 975 acres in old Amelia County on September 20, 1748, and bought and sold other parcels of land up to the time of his death. A member of the Anglican church, Theodrick offered 300 acres of land to St. Patrick's parish for its use as a glebe, or plot of land granted to the local clergyman as part of his benefice during his tenure of office.

Theodrick made his will on December 7, 1777. The executors of his estate were Nathaniel Venable and Francis Watkins, two of Prince Edward County's most respected citizens. Venable was a member of the Virginia Assembly in 1766-1768; three of his sons were educated at Princeton, and one served in the United States Congress. Venable lived at Slate Hill, now in the National Register of Historic Places. Watkins was deputy clerk of the Prince Edward County court from 1767 to 1783; he was appointed clerk in 1783, retiring from that office in 1823. His home was called "Poplar Hill." Venable and Watkins were also charter trustees of Hampden-Sydney College, founded in Prince Edward County in 1776.
The following is Theodrick Carter's will:
In the name of God, Amen: I Theodrick Carter of the Parish of Saint Patrick and County of Prince Edward being of perfect and sound mind and memory do make and ordain this to be my last will and testament in manner following.
First, I give unto my daughter Susannah Stubblefield and sons John, Theodrick and William Carter each one shilling sterling. I give and bequeath unto my son Richard Carter one negro man named Dick, and one feather bed and furniture to him and his heirs forever. I give and bequeath my daughter Nanny Waddill Thompson one negro girl named Tibb now in her possession, also two cows and calves to her and her heirs forever. I give and bequeath unto my son Waddill Carter that part of my lands within the following bounds, to begin at the cross branch at the road, to run a straight line by the grave yard to his own line, all the land below this line on the North side of said road, also one negro man named Tom to him and his heirs forever. That Patriot Samuel Carter is the son of Ann Waddill and the husband of Elizabeth McRobert is proven by his associations with his brothers, Waddill, and his Chancery Suit in Prince Edward for his share of his Father's Still [purchased by Theodorick3 and his son, Waddill. He is also the elder of the two, closely related Samuel's. The Samuel Carter who is the owner of Carter's Tavern is the son of Theodorick4 and his wife, Judith Cunningham. This Samuel Carter, Married Elizabeth H. Neal 8 Sep 1812 in Halifax Co., VA. [Original marriage record shows Elizabeth H. Bibb as she is a Widow, and whose mother is Martha Neal and Bondsman or Security as Wm. Neale Jr.] His 2nd wife, Betsy M. Holcomb is the Widow of John H. Holcomb, and names her Holcomb sons in her will of 1844. The Margaret B. Carter who witnesses her Will, is identified as her Sister-in-law. It should also be noted that the Household of Samuel Carter and Betsy included the orphan of his nephew, William and Mary Hobson, as well as the Holcomb orphans. Additionally, Samuel 'Tavern Keeper' identifies his brother as Alexander Carter.

Samuel Carter (-1830) gave support to the Army during the Revolution. He represented Prince Edward County in the Virginia House of Delegates (1805-6).

The May 4, 1830 issue of the Richmond Gazette carried the following notice of Samuel's death:

Died, on the 29 ult. at his residence in Prince Edward county, Capt. Samuel Carter, in the 76th year of his age. The disease which terminated his existence was of long standing and grievous; but he bore it with the utmost patience, and met death with a firmness that had characterized him throughout his long and useful life. It cannot be necessary to lay before the public a particular detail of the useful part he acted, during an arduous struggle for Liberty and Independence: let it suffice to say, he embarked in the cause of freedom at the earliest period of our conflict with the Mother County, and his zeal never abated or tired in its defence. He was in the battles at Germantown, Long Island, Brandywine, and, in short, most of the hard-fought actions to the North, in which he distinguished himself as an undaunted, intrepid officer and soldier. His conduct and services after peace was established proved his ardent attachment to pure republican principles, and is worthy of all praise. He was soon called to fill, and did then also distinguish himself by a most happy, judicious exercise of his superior, natural, mental endowments. No one knew man better than Capt. Carter; and no one did, or can excel him in the possession of those rare qualities, which so pre-eminently fits man for usefulness to his fellow man. As a man, he was scrupulously just-- His hospitality was proverbial, and his charity, which was exercised for charity's sake, knew no bounds. As a husband and a father, he was affectionate and tender, almost to a fault-- As a master, he was kind and humane; and his superior he has not left behind him.

The other Carter is a William Carter. He is mentioned in the chancery documents in 1789 as the defendant against Onan Moody. Onan Moody was the illegitimate daughter (or son, not sure) of Frances Moody and Gerard Ellyson. Gerard's widow, Sarah (nee Crews), married William Carter in 1771. It was published in the Purdie and Dixon Gazette that she was 85 and he only 23! (Making William born in 1748). It also mentions that he is the son of John Carter of Henrico County. (This John Carter is the son of Theodrick Carter, the son of Giles Carter.) William had the following siblings:

"An act of the general assembly of Virginia was passed in October, 1786, for clearing and extending the navigation of the Chickahominy River, and William CARTER, a descendant of Giles Carter (First), was one of a committee of trustees appointed to supervise the clearing of the channel as far up as Meadow Bridge."

John Carter's Will was executed 18 JUN 1781, and probated before the court held for Halifax Co., VA on 20 SEP 1781. The witnesses were Benjamin Hobson, David Bates, Noel Waddill, Theodrick Carter (Third) and Charles Carter, a son of Theodrick Carter(Third). The Executors named were his wife, Mary Carter, Captain James Turner, William Boyd and John Carter's brothers Richard and Theodrick (Third).

John Carter's three eldest children, Richard, Theo, and Robert filed a chancery suit in Halifax county in 1799 [19 years after the death of John] charging the Executors [Mary Carter, their mother] and Richard Carter, dec'd and his executor Susannah Powell (nee Carter) for monies not accounted for when Richard Carter bargained and sold land privately. Mary Carter (nee Cunningham) is still alive at this time, and gives testimony referring to Richard Carter's affidavit. Robert appears to act as attorney and questions many witnesses. The suit is then refiled in Richmond County and continues. Polly Powell (nee Carter), wife of Mastin Powell and d/o Susannah Carter Powell (nee Bigger) testifies to angry words between Robert and Susannah, his aunt. The suit continues whereby Robert questions numerous witnesses as to the quality of his education, and of the ability of the estate of the dec'd John Carter to produce enough to keep the widow and children adequately. [it is obvious to this researcher that Robert is an ambitious, determined and combative individual and probably was of the same personality since his childhood, when he admits he would not be schooled.] He challenges that his education and that of his siblings was less than he considered their due. Both he and Theo, though, can write and sign their names, as does Susannah. This research shows that Theodrick, s/o John of Halifax and Mary Cunningham is the Theo who married Molly Elbank. This Theo owned two lots on Main Street in Farmville which he sold 1/2 interest in, to Augustus Watson who then sold it to Edward Dillon. If this is true, (that this Theo married Ms. Ellbank, she was not mentioned in the Chancery suit of 1825. Other researchers believe the Theodrick who married Ms. Elbank is the Theo who later married Judith Cunningham and Ms. Townes. Need accurate death date for Theo, s/o John and Mary Cunningham Carter. Land transfers to Dillon will give better grasp on the date of death for Theo and Augustus Watson who bought the lots and then sold to Edward Dillon. SEARCH PRINCE EDWARD DEEDS FOR SALE OF THEO LOTS No 10 & 11 ON THE WEST SIDE OF MAIN STREET IN THE TOWN OF FARMVILLE, VIRGINIA.

Although this Theodorick is shown as Theodorick of Halifax, it is questionable that he lived in Halifax as did his other family; a Prince Edward Co., Virginia Chancery Suit names his brothers and sisters as his heirs, and states he died intestate. I believe the Pay Roll Document showing Theodorick Carter and John Carter in the 1814 is attributed to this Theo whose Chancery Record shows that he died intestate before 1825 and leaving as heirs, his siblings. The John Carter shown on this document is either the s/o Waddill, Richard or Wm. T. of Prince Edward- Mary Frances Eggleston

The will of John Carter, of Halifax County, amongst other provisions, devised to his three sons, Richard, Robert and Theodrick, four hundred and fifty acres of land purchased from George Ridley. The records of Halifax County, Virginia, show that Robert Carter sold his share of the land to George Marable.

The court records of Halifax County, Virginia confirm that Robert Carter was married to Unity Cook, by William P. Martin, November 1st, 1792. The last business transaction recorded by Robert Carter, in Halifax Co., Va., prior to his removal to Tennessee, was the sale of two negroes to William Ferrell on June 19th, 1801. Robert Carter moved with his family to Tennessee about 1805. Robert Carter continued to reside at Franklin, Tennessee, until his death, September 9th, 1839, in his 69th year. His will was burned while in the possession of one of his grandchildren, at Nashville, Tennessee. A list of personal property, in his possession at his death, is recorded at Franklin, Williamson County, Tennessee. Robert Carter and Unity Cook produced six children, Sarah Venable, Henry Cook, John Blackgrove, Robert Michaux, Polly, and Samuel Jefferson Carter, all of whom, according to the family Bible. Two other children, another Mary and Nancy, did not survive infancy.

Samuel Jefferson Carter, son of Robert and Unity Cook Carter, was born in Halifax County, Virginia, January 3d, 1803, and died suddenly at Carter's Landing, West Tennessee, March 31st, 1873, leaving no will. He married, as shown by the family Bible, first Eliza Staggs, and had three children: Watson M., Jordan B., and Eliza S. Samuel Jefferson Carter married second Anne Vaulx, and had fourteen
children: Warren, Hays, Watkins Leigh, Charles Vaulx, Samuel J., Laura O., Irene M., Samuel Jefferson, William Giles Harding, Anne Catharine, Frank Cook, Ella Watson, Vaulx, Mary Hays. Of the eleven sons of Samuel Jefferson Carter, the first eight are deceased without male issue. General William H. Carter has one son, William Vaulx Carter, and Frank Cook Carter has one son, William Dawley Carter. These two young men, William Vaulx Carter and William Dawley Carter, are all of their generation bearing the name of Carter, in the direct line traced in this memoir. Samuel Jefferson Carter resided with his family in Davidson County, near Nashville, Tennessee, prior to 1861, and in Nashville during the Civil War. At the time of his death he was residing on his farm in West Tennessee, near Carter's Landing, on the Mississippi River.
WILLIAM GILES HARDING CARTER was married, October 27th, 1880, at San Francisco, California, to Ida Dawley. Two sons have been born of this marriage, William Vaulx Carter (who was graduated from West Point in 1904 and appointed a lieutenant in the Sixth United States Cavalry, his father's old regiment), and Leigh Hays Carter, who, while a student
at the University of Illinois, was accidentally killed
by an electric shock in one of the University buildings, August 27th, 1907.

Many pages of testimony follow demonstrating not only that money was paid to Richard, but never passed on to the family. The position of David Powell and Susannah is that the children were educated and provided for, out of the estate of their father, John Carter, dec'd. Robert appears to act as attorney and questions many witnesses. The suit is then refiled in Richmond County and continues. Polly Powell (nee Carter), wife of Mastin Powell and d/o Susannah Carter Powell (nee Bigger) testifies to angry words between Robert and Susannah, his aunt. The suit continues whereby Robert questions numerous witnesses as to the quality of his education, and of the ability of the estate of the dec'd John Carter to produce enough to keep the widow and children adequately. [it is obvious to this researcher that Robert is an ambitious, determined and combative individual and probably was of the same personality since his childhood, when he admits he would not be schooled.] He challenges that his education and that of his siblings was less than he considered their due. Both he and Theo, though, can write and sign their names, as does Susannah. The testimony of Frederick Miller links the Gunsmith to these Carter lines; he marries the Gunsmith's Daughter. Henry Hobson and others testify as well.

Eliza's great-uncle John Carter (through her mother's line) was the father of Francis Watkins Carter, who built the home which is currently open for tours as Carter House Museum in Franklin, TN. One of her cousins was Confederate Lt. Theodorick "Tod" Carter, who died in a battle with Union troops on the lawn of the home during the Battle of Franklin, November 30, 1864. In a sad tale reminiscent of so many of the era, family fought family as Eliza's son John joined the Union in combat with Missouri's Militia Regiment 5, Company B.

Philip borrows money from James Stevens, who is Nathaniel Carter's father-in-law, and must sue his estate for payment to be credited properly. Philip makes purchase along with Nathaniel Carter, at the sale of the Estate of Sarah Royal Terry. Philip's Revolutionary War Pension Application identifies his wife and children, places him in Halifax County and names his brother James. Wm. Tuck [another Carter associate] gives testimony as to the veracity of Philip's statements in his Pension Application.

What is it that you want to add?
My reasoning is that James Vaughan is involved with the individuals included in the Lines of Richard Carter and Susannah Bigger; he is guardian and gives consent for the marriage of Nancy LeGrand to William Turner in Halifax Co. His ward Elizabeth 'Betsy' Turner, d/o Nancy LeGrand and William Turner, married one of my grandfathers, William George 'Buck' Carter. The LeGrands removed to Tennessee; but Betsy is found in Halifax with James Vaughan acting for her father. This James Vaughan also acted as Bondsman for William Carter who married Mary Hobson. Wm., a son of Susannah Bigger and Richard Carter. Richard had died in 1797 and James Vaughan acted in his stead. Further, Wm. Carter's birth is about 1778, Halifax Co., VA. He marries Polly in 1801 probably right after his 21st birthday, which is exactly what we would expect. If the Wm. who married Mary Hobson was the s/o Theodorick as other researchers propose, he would have been born in the 1740's, or at the latest 1750. By 1801 he would have been 50 or more. I just can't see that being the case. Another William candidate is the s/o Theodorick4 and his first wife, Ms. Townes. He is in Prince Edward, later in Halifax with an estimated birth of 1765. I do not think there is a Will for this William, but I will double check when I am in Halifax next month.

They were located on the Pittsylvania Co., side of Halifax; Jesse, his brother married Susannah Adkins, who is also from Pittsylvania Co., VA

So, as you see, there is no direct evidence that has turned up as of now. This is just my theory of one other member of my Carter line. Note: I can be wrong, but this is my best guess. The LVA is in the processing and scanning the Halifax Chancery Records and they are not yet available. They may tell us more, if I live long enough for them [LVA] to finish.

I think the birth date for Lemuel Carter Sr who dies in Caswell County, is probably more like 1780 ? 82. If we believe the 1850 Census of Halifax County, Virginia, where I think the ages are inaccurate, then he would not have been a minor if born in 1774.... when his father died ca 1796. And his wife shows as born 1790 which would make her 11 years old if Lemuel Cartrer Sr and Martha ?Patsy? Carter actually married in 1801 in Halifax, County. In the 1860 Census in Caswell County, North Carolina, Lemuel Carter shows as L. Carter and it states a birth age similar to that in the 1850 Census in Halifax County. The probate records in Caswell County show this is the same Lemuel Carter Sr. The probate records images for Caswell County on this site show show Lemuel Carter Sr. had a son named John and Lemuel Carter. Lemuel Jr. had a son John Flint who also had a son John Flint Carter. These Lemuel Carter attachments in the tree are not transcriptions and are actual images which is really fantastic.

The DAR Record that says Elizabeth Carter b 1787 (supposedly a daughter of Waddill Carter and Mildred Wade) is shown born two years after her father Waddill died. There is a mistake here. Nancy Elizabeth Carter, d/o Waddill & Mildred Wade Carter is thought to be born in 1765, which would put her the right age to have married John Boisseau. There are other Waddill Carters in the Halifax Virginia and Caswell Co., NC area, which are situated very close to one-another. Unless there is a second daughter of Waddill and Mildred Wade Carter whose name is Elizabeth, I cannot agree with the DAR record until further evidence is established. The records of the DAR are being investigated.

Long a familiar landmark on Halifax County's historic and scenic River Road, Carter's Tavern is a handsomely restored example of an early southern Virginia ordinary. With virtually all of its original interior fabric intact, the venerable frame building provides a rare picture of the character and arrangement of this once common Virginia institution. An outstanding feature of the tavern is the great quantity of well-preserved grained and marbelized woodwork, some of which is unusually ornate. The building's earliest portion is the one-and-a-half-story wing, probably erected before 1773 by Joseph Dodson.
Licenses issued in 1802 and 1804 indicate that Dodson's younger son, Joseph, Jr., operated an ordinary there in what was also his residence. In 1807 Dodson sold the building and 67 acres to Samuel Carter. Carter is believed to have enlarged the building to its present size by tearing down part of the Dodson house and erecting the two-story main section. In any case, the enlarged building enabled Carter to operate an overnight stage stop. The earliest recorded license issued to him, in 1821, authorized Carter to keep "a house of private entertainment" a this residence. His license was renewed in 1824, 1829, 1830, 1833, 1834, and 1835. Following Carter's death in 1836 his wife, Elizabeth, [Elizabeth Holcomb, (nee Cocke) took over operation of the establishment. As the River Road was a lap on the main stage road between New York and New Orleans, Carter ' s Tavern remained an important stopping place. "Betsy" Carter continued as proprietress of the tavern until her death in 1844, at which time it was permanently closed. In 1860 Samuel Carter's son, Philemon, sold the property to Dr. Thomas Haynie. The Haynie family owned it u n t i l 1898 when the building and 150 acres was sold to Mrs. Martha E. Reaves. After the Reaves family sold the property in 1941 it passed through various owners until 1972 when the derelict, decaying building was acquired by Mr. and Mrs. Robert H. James Blagrove and Ann Carter, is the daughter of Theodorick of John1 Carter and his wife Ann [unknown] and further suggests another daughter, Elizabeth who married William Francis.

Further 9 Sep 1801 William Francis married Betsey West, widow of John. so this Elizabeth did not survive long after her marriage, if this is the same William Francis.

U.S. Army officer, Thomas Flournoy (1775-1857), sometimes referred to as "John Thomas Flournoy," was born in North Carolina and, before the War of 1812, practiced law in Augusta, Georgia. In March 1804, Flournoy was involved in a duel with John Carter Walton (1741-1804), nephew of former Georgia Governor and Supreme Court Chief Justice George Walton, over the judge's decisions for the Thomas Flournoy vs. George Walton and Matthias Maher vs. George Walton cases. Flournoy shot and killed John Walton in the duel.
